Drunk driving in South Africa is a killer on our roads that has caused a vast number of fatalities and this has given us the reputation of having the highest number of drunk driving incidents in the world at 58%, according to a 2015 report.

According to the National Road Traffic Act 93 of 1996  has set out the legal alcohol limits for driving whilst under the influence and the guidelines set makes even a “small drink” such as a single tot of brandy or other spirits, or even a 350ml of beer put you at risk of potentially being over the 0.05% blood alcohol limit.

Drinking and driving, like a variety of other traffic infringements is classified as a criminal offence and can see individuals arrested for this offence with a minimum R2000 fine or a 2-year prison sentence, dependent on previous convictions against the individual. Of course, along with a possible prison sentence, individuals will have a criminal record that could negatively affect their lives in a variety of ways in the future.

Unfortunately, when it comes to your rights, you have the same rights as anyone else arrested for a criminal offence, so when it comes to the topic of drinking and driving, the solution is – stop drinking or stop driving. Whilst not drinking would be ideal, the more realistic would be to not drive when you plan on drinking, by pre-planning your time out and ensure a safe and reliable transport home.
